COLUMBUS, Ind. — The online publication motorsport.com/ is reporting a mediator has been appointed in the case involving Tony Stewart and the family of Kevin Ward.
Glenn Norton will mediate the session scheduled for April 18, in St. Louis. Johnny Cargil from the Houston-based Lanier Law Firm will represent the Wards and Brian Gwitt of Woods, Viatt and Gilman from Rochester, New York, will represent Stewart. The mediation session is non-binding.
On August 9, 2014, during competition at the Canandaigua Motorsports Park, drivers Ward and Stewart were involved in an incident that caused Ward to spin out. During the caution period that followed, video shows Ward exited his car and walked down the track. Stewart’s sprint car came out of a turn and struck and killed Ward.
After an Ontario County, New York court failed to criminally indict Stewart, the Ward family filed a wrongful death lawsuit in April 2015. Stewart has maintained the incident was an accident.
