DELPHI, Ind.– Allen Superior Judge Fran Gull issued an order Tuesday denying the state’s request to keep the probable cause affidavit in the Richard Allen arrest sealed.
According to a copy of an edited version of the probable cause affidavit obtained by Indystar, Allen is alleged to have committed the killings while kidnapping the girls, although he has not yet been charged with kidnapping. A .40 caliber shell found near Libby German or Abby William’s body had tool marks that match Allen’s pistol, according to the affidavit. It also includes redactions when witnesses are cited, and while it doesn’t say how the teenagers were killed, it confirms it occurred on the north banks of Deer Creek.
Carroll County Prosecutor Nick McLeland had been advocating for records relating to the case to remain sealed to retain the integrity of the investigation.
Allen is accused of murdering Delphi teenagers Abby Willams and Libby German in 2017.
